SERVICE CONTRACT

THIS AGREEMENT MADE THIS_______DAY OF BETWEEN   K. Duane Mackey   of  M&M Sounds (hereinafter referred to as "ARTIST') AND ______________________ (hereinafter referred to as "PURCHASER").  

IT IS MUTUALLY AGREED BETWEEN THE PARTIES AS FOLLOWS: The PURCHASER engages the ARTIST, and the ARTIST hereby agrees to perform the engagement hereinafter provided, upon all terms and conditions herein set forth.

ALL PAYMENTS SHALL BE PAID BY CERTIFIED CHECK, MONEY ORDER, BANK DRAFT, OR CASH AS FOLLOWS (IMPORTANT CHECKS SHALL BE MADE PAYABLE TO:  K. Duane Mackey  )

(A) $________shall be paid by PURCHASER to and in the name of ARTIST not later than    ___________ as a non-refundable deposit which will reserve the ARTIST's services for the above date. In the event of a cancellation of services by PURCHASER the deposit is NOT refundable.

(B) Additional payments, if any, shall be paid by PURCHASER to the ARTIST NO LATER THAN _____

(C) In the event of a "no show" by the ARTIST, the PURCHASER agrees to hold the ARTIST liable for an amount not to exceed the full price agreed to by both parties on this contract.

5. ARTIST shall have the sole and exclusive control over the production, presentation and performance of the engagement hereafter, including but not limited to the details, means and method of performances of the performing artist hereinafter, and the ARTIST shall have the sole right, as the ARTIST may see fit to designate and change at any time the performing personnel. The ARTIST's obligations hereafter are subject to: detention or prevention by: illness, inability to perform, accident, means of transportation, acts of God, riots, equipment failure or events beyond the ARTIST's control.
